Renting in Albany with an assistance animal
Albany has about 102,000 residents and grew 2.6 percent between 2020 and 2025, one of the few upstate cities on this list gaining population. As the state capital it has an unusually stable employment base, and its rental market carries a steady flow of state employees, legislative staff and students from UAlbany and the College of Saint Rose.
Two very different housing types
Albany's rental stock divides sharply. Center Square, Hudson/Park and Washington Park are dense with nineteenth-century brownstones subdivided into flats, usually owned by individuals. The neighbourhoods toward the university and out along Western Avenue have more purpose-built apartment complexes with professional management.
The brownstones tend to have older leases with blanket no-pet clauses and owners who have never handled an accommodation request. The managed complexes have a process but also explicit pet fee schedules. In both cases, request in writing before signing where you can.
Historic districts do not change your rights
Albany has several historic districts with preservation requirements attached. Those govern what can be done to the building, not whether you may keep an assistance animal. If a landlord cites a historic designation as a reason to refuse, that is not a housing accommodation answer.
You are close to the enforcement agency
A small practical advantage of renting in the capital: the New York State Division of Human Rights is a state agency headquartered in New York but operating statewide, and Albany tenants are generally well served by state offices. Complaints under the New York State Human Rights Law go there. The NYC Human Rights Law does not apply outside the five boroughs.

In May 2026, HUD rescinded its 2020 assistance animal notice and narrowed federal enforcement to animals individually trained to perform disability-related work. New York felt that less than most states, because the New York State Human Rights Law is separate, still in force, and has a broader disability definition than federal law. Albany ESA letter questions
Does a historic district designation affect my ESA request?
No. Preservation rules govern changes to the building, not whether a tenant may keep an assistance animal as a reasonable accommodation. A landlord citing historic status as a reason to refuse is not giving a housing accommodation answer.
Where do I file a complaint if my Albany landlord refuses?
The New York State Division of Human Rights, which enforces the New York State Human Rights Law statewide. The NYC Commission on Human Rights has no jurisdiction outside the five boroughs.
Should I request before or after signing my lease?
Before, if you can. Requesting up front means the lease is drawn without pet rent or a pet deposit attached to your assistance animal. Reversing charges later takes longer.
